The ex-lawyer for the former president has resigned as the US Attorney for New Jersey. This decision was prompted by a judicial decision that challenged her eligibility to hold the office.

Official Departure

US Attorney General, Pam Bondi, announced Habba's resignation on the start of the week. She commented that the court's "flawed" ruling made it impossible for the official to effectively run her office.

"Let no one confuse compliance for surrender," she wrote. "The effort will now extend throughout the country."

Legal Background

Habba's exit follows closely on a judicial panel determined that she had been serving in violation of the law as the federal prosecutor. This judgment is likely to affect many legal proceedings in the Garden State.

The court said that a temporary posting that did not receive confirmation by the US Senate violated the Federal Vacancies Reform Act.

Ongoing Legal Battle

Bondi said that she will stay on at the Department of Justice as a high-level advisor. Habba plans to challenge the decision of the disqualification, with hopes of a reversal.

On a social media platform, the Attorney General wrote that the court "should not be able to second-guess the appointment of prosecutors tasked with executing the executive branch's core responsibility of criminal prosecution."

The 41-year-old attorney, was initially recruited to Trump's personal legal team in recent years. Subsequently, she defended her client in his New York criminal case in 2024, which resulted in his conviction on 34 counts of falsifying business records.

Earlier, her appointment to the role of US Attorney, Trump had revealed he was appointing her as his presidential counsellor during his second administration, describing the lawyer as deeply loyal and a dedicated fighter for justice.
